Thank you for your interest in BIXS. Protecting your personal data is an important concern for Intercycle AG ('Intercycle', 'we', 'us'), the company behind the BIXS brand. You can generally use the BIXS website (bixs.com, the 'website') without providing personal data. However, if you wish to use certain services through the website—such as contacting us, subscribing to our newsletter, or finding a dealer—the processing of personal data may be required.

We process personal data in accordance with the Swiss Federal Data Protection Act (DSG) and, insofar as applicable to visitors from the European Union—especially Germany and Austria—with the EU General Data Protection Regulation (GDPR).

Please note: Purchases cannot be made through the website. BIXS products are distributed through our authorized dealer network. Therefore, this privacy policy does not cover order or payment data. It does not claim to provide a comprehensive description of all our data processing practices; individual cases may be governed by specific data protection notices or terms and conditions.

2. Data Protection at a Glance

  • What we process: Contact and identification data you provide to us (e.g., via forms or newsletter registration), as well as technical website data that is automatically collected when visiting the website (e.g., IP address, browser information, usage data).

  • Why we process it: to operate, secure, and improve the website, to respond to your inquiries, to send you our newsletter if you have subscribed, and—with your consent—for analysis and marketing purposes.

  • With whom we share it: Service providers operating the website and its services on our behalf, as well as authorized BIXS dealers (see sections 5, 6, and 12). We never sell your data.

  • Where it is processed: primarily in Switzerland or the EU/EEA area. Individual service providers may process data in other countries; in such cases, we ensure appropriate safeguards (see section 13).

  • Your rights: You have the right to access, rectify, erase, restrict, port, and object to your data and can revoke consent at any time (see section 16).

 

3. Personal Data We Process

Depending on how you interact with the website, we process in particular:

  • Contact and identification data such as first and last name, title, language, consent status, email address, phone number, and postal address when you provide them to us (e.g., through contact forms, newsletter registration, warranty forms, or applications);

  • Communications data such as the content of your inquiries and our correspondence with you;

  • Technical and usage data such as IP address, date and time of access, pages and content visited, referring website, browser type and version, operating system, device type, language settings, and cookie identifiers.

We do not process order or payment data through the website as purchases are not possible through it.

 

4. Purposes and Legal Bases of Processing

We process personal data for the following purposes:

  • Provision, operation, and security of the website, including defense against attacks on our IT systems (legitimate interest, Art. 6 para. 1 lit. f GDPR);

  • Responding to and processing your inquiries, including forwarding inquiries directed to a specific dealer (e.g., test ride or availability inquiries) to that dealer (contract fulfillment or pre-contractual measures, Art. 6 para. 1 lit. b GDPR, or legitimate interest);

  • Sending our newsletter if you have subscribed (consent, Art. 6 para. 1 lit. a GDPR);

  • Web analysis and marketing if you have consented via our cookie banner (consent, Art. 6 para. 1 lit. a GDPR);

  • Fulfillment of legal obligations and the assertion, exercise, or defense of legal claims.

If processing is based on your consent, you can revoke it at any time with future effect. Revocation does not affect the legality of processing carried out before the revocation.

 

5. Hosting and Technical Service Providers

The website is operated on Salesforce Commerce Cloud, an e-commerce and web platform by Salesforce, Inc. The contents of the website (texts, images, videos) are managed and delivered via Storyblok, a content management system by Storyblok GmbH, Austria, and its Content Delivery Network. These providers process technical data (such as IP addresses and access data) on our behalf as data processors under data processing agreements and solely for the purpose of providing and securing the website.

 

5.1 Server Log Files

Each access to the website is temporarily stored in server log files. Collected are in particular your IP address, date and time of access, the accessed file or page, the access status, the browser used, and the operating system, as well as the referring page. This data is processed to correctly deliver the website, ensure its stability and security, and detect, investigate, and fend off attacks and other illegal activities. Log data is deleted or anonymized as soon as it is no longer needed for these purposes.

 

6. Contact and Inquiries

You can contact us via the contact options on the website (e.g., contact form, warranty form, or email). The data you provide will be processed to handle your inquiry and any follow-up questions and will not be disclosed to unauthorized third parties. Fields marked as mandatory are required to process your request; additional information is voluntary. Your data will be deleted once your inquiry has been fully processed, unless legal retention obligations require longer storage.

If your inquiry concerns a specific BIXS dealer—for example, a test ride inquiry, an availability request, or the desire to be contacted by a nearby dealer—we will forward the data needed for processing (in particular name, contact data, and content of the inquiry) to the relevant dealer. The dealer processes this data independently to respond to your inquiry.

Job postings on the website link to the career pages of the hostettler Group. Applications are not collected through this website; the privacy policy published on the hostettler website applies to applications.

 

7. Newsletter

On the website, you can subscribe to our free newsletter. For this, we require a valid email address and your preferred language; providing your name is optional and is used for personalized addressing. The registration is done using the double opt-in procedure: After registering, you will receive an email with a confirmation link. Your data will be used exclusively for sending the newsletter.

Our newsletters may contain tracking elements (e.g., pixels and links) that record whether and when a newsletter was opened and which links were clicked. We use this information to measure and improve the quality of our newsletter. For sending and evaluating our newsletters, we use the Salesforce Marketing Cloud.

You can unsubscribe from the newsletter at any time via the unsubscribe link in each newsletter or via the contact details in section 1.

 

8. Cookies and Consent Management

We use cookies and similar technologies (e.g., local storage) on the website. Cookies are small text files that are stored on your device via your browser. Some cookies are technically necessary for the operation of the website (e.g., language and consent settings); we use these based on our legitimate interest in a functioning website. All other cookies - especially for analysis and marketing - are only set with your consent.

On your first visit to the website, our consent management platform Cookiebot (Usercentrics A/S, Denmark) asks for your consent to non-essential cookies. Cookiebot stores your consent decision (including an anonymized identifier, the date and time of consent, as well as your consent status) to document and respect your choice. You can adjust or revoke your consent at any time via the link to the cookie settings on the website. You can also configure your browser to inform you about the setting of cookies, allow cookies only in individual cases, or generally reject them; some functions of the website may then not be available.

 

9. Analysis and Online Marketing

The following services are only used if you have consented through our consent management platform. Consent can be revoked at any time through the cookie settings.

 

9.1 Google Tag Manager

We use Google Tag Manager, a service of Google Ireland Ltd. (“Google”), to manage website tags. Google Tag Manager itself does not set cookies and does not collect personal data; it triggers other tags that may collect data, as described below.

 

9.2 Google Analytics

We use Google Analytics 4 to analyze the use of the website. Google Analytics uses cookies and similar technologies, which allow an analysis of your use of the website (e.g., pages accessed, interactions, approximate location at the country/city level, technical browser and device information). IP addresses are not stored by Google Analytics 4. The generated information is usually transmitted to a server of Google and can be processed in the USA. We use the resulting reports to understand how the website is used and to improve our content and offerings. 9.3 Google Ads

We use Google Ads including conversion tracking and remarketing to measure the effectiveness of our advertising and show you interest-based advertising in Google services and on partner websites. For this purpose, cookies are set when you arrive at the website through a Google ad, and your use of the website can be assigned to advertising target groups. 9.4 Meta Pixel

We use the Meta Pixel from Meta Platforms Ireland Ltd. (“Meta”) to measure the effectiveness of our advertising on Facebook and Instagram and show you interest-based advertising there. The Meta Pixel allows Meta to recognize you as a visitor to the website and associate your visit with your Meta account. Data may be transferred to Meta Platforms, Inc. in the USA. 10. Dealer Search, Maps, and Embedded Content

 

10.1 Google Maps

Our dealer search uses Google Maps to display interactive maps and dealer locations and to open routes. When loading map content, information about your use of the website (including your IP address) may be transmitted to Google and processed in the USA. If you are logged into a Google account, Google can associate this data with your account. 10.2 Embedded Videos (YouTube and Vimeo)

We embed videos from YouTube, a service of Google Ireland Ltd., and from Vimeo, a service of Vimeo.com, Inc., USA. When you start an embedded video, a connection is established to the servers of the respective provider, which allows the provider to know which of our pages you visited. Information about your use of the website (including your IP address) can be transmitted to the provider and processed in the USA. If you are logged into your YouTube/Google or Vimeo account, the provider can directly associate this data with your account; you can prevent this by logging out before starting the video. Videos provided directly via our own content infrastructure (our Content Delivery Network) do not involve third-party platforms.

 

11. Links to Third-Party Websites

The website contains links to third-party websites, for example, and without limitation: the websites of our dealers, the career pages of the hostettler group, or social media platforms. These websites are not under our control, and we assume no responsibility for their content or their handling of personal data. When you follow such links, the privacy policy of the respective operator applies; we recommend that you review it. Using linked websites is at your own responsibility.

 

12. Disclosure of Personal Data to Third Parties

We only disclose personal data to third parties as permitted and appropriate, particularly to:

  • authorized BIXS dealers (e.g., when requesting a test drive, an availability inquiry, or the desire to be contacted), insofar as this is necessary for the dealer to process your request;

  • service providers and processors (e.g., hosting, content management, email dispatch, IT services, analysis) who process data on our behalf and according to our instructions;

  • companies of the hostettler group, insofar as this is necessary for the purposes described in this statement;

  • Authorities, courts, and other official bodies, to the extent we are legally required to do so or necessary for asserting, exercising, or defending legal claims.

We do not sell your personal data.

 

13. Place of Processing and International Transfers

We primarily process personal data in Switzerland and the EU/EEA area. Some of the service providers mentioned in this statement (particularly Salesforce, Google, and Meta) may process data in the USA or other countries without adequate data protection levels. In these cases, we ensure appropriate safeguards, particularly through the European Commission's Standard Contractual Clauses (including the Swiss Addendum recognized by the Federal Data Protection and Information Commissioner), and, where applicable, through certifications under the Swiss–U.S. or EU–U.S. Data Privacy Framework.

 

14. Retention

We process and store personal data as long as necessary for the purposes described in this statement or as required by statutory retention obligations. Once your personal data is no longer needed for these purposes, it is deleted or anonymized.

 

15. Data Security

We take appropriate technical and organizational measures to protect your personal data from manipulation, loss, destruction, and unauthorized access, including the encrypted transmission (TLS) of all data entered on the website. Our employees and service providers are obligated to maintain confidentiality and comply with data protection laws and have access to personal data only to the extent necessary.

 

16. Your Rights

In accordance with and within the limits of applicable law, you have the right to:

request information about the personal data we process about you;

  • request the correction of incorrect personal data;

  • request the deletion of your personal data;

  • request the restriction of processing;

  • receive your personal data in a structured, commonly used, and machine-readable format (data portability);

  • object to processing based on legitimate interests, including direct marketing;

  • withdraw consent at any time with effect for the future.

If you believe that the processing of your personal data violates data protection law, you can file a complaint with the competent supervisory authority. In Switzerland, this is the Federal Data Protection and Information Commissioner (EDÖB, www.edoeb.admin.ch). If you reside in the EU/EEA area, you can also contact your local data protection supervisory authority.

 

17. Minors

The website is not directed to children, and we do not knowingly collect personal data from children. If you believe a child has provided us with personal data, please contact us so we can delete it.

 

18. Changes to this Privacy Policy

We may update this Privacy Policy at any time to reflect changes in our practices or for legal, operational, or regulatory reasons. The version published on the website applies.

This Privacy Policy is available in German, French, and English. In the event of discrepancies, the German version is authoritative.
