These General Terms and Conditions (hereinafter "Terms of Use") govern the use of the website bixs.com and all its accessible subpages (hereinafter "Website").

intercycle ag is a company of the hostettler group and the owner of the BIXS brand (hereinafter "BIXS", "we").

By using the website, you agree to these Terms of Use. If you do not agree, please do not use the website.

2. Purpose of the Website: no ordering and sales platform

The website is solely for presenting the BIXS brand, our range of products, editorial content, and information about our dealer network.

No products can be ordered or purchased via the website. There is no ordering function, no shopping cart, and no customer account available for consumers or business customers.

The presentation of products on the website does not constitute an offer in the legal sense. No purchase or any other contract for the delivery of goods is concluded via the website.

The purchase of BIXS products is done exclusively through our retail partners. The conditions of the respective retailer apply for the purchase.

3. Product Information, Prices, and Availability

We prepare the product information on the website with great care. Images, specifications, geometry data, weight information, and features serve as a guide and may differ from the product actually delivered.

Weight specifications refer to a specific frame size and configuration and may vary due to production. Color representations may vary from the original depending on the screen.

If prices are listed on the website, they are non-binding recommendations in Swiss Francs, including VAT. Pricing is the responsibility of the respective retailer.

We reserve the right to change the range, models, specifications, and prices at any time and without notice. There is no entitlement to the availability of a specific model, color, or size.

Obvious errors and typographical mistakes do not entitle you to any claims.

With the dealer search, you can find BIXS retail partners near you. We keep this information up-to-date, but cannot guarantee the accuracy, completeness, and up-to-dateness of dealer data, opening hours, or the on-site range.

Retail partners are legally independent companies. They act in their own name and on their own account. We are not a party to the contracts concluded between you and a retailer and are not liable for their advice, services, or conduct.

5. Newsletter

You can subscribe to our newsletter on the website. Subscribing is voluntary and follows a double opt-in process: After entering your email address, you will receive a confirmation email to complete the subscription.

You can unsubscribe at any time via the unsubscribe link at the end of each newsletter. Details on data processing can be found in our privacy policy.

6. Warranty, Guarantee, and Product Safety

Warranty and guarantee claims are generally made with the retailer from whom you purchased the product. Legal provisions and our warranty conditions in their current version apply.

Bicycles and e-bikes are technical devices. Use them exclusively as intended and within the scope described in the respective user manual. Assembly, initial operation, maintenance, and safety-relevant work should be performed by a professional workshop.

The riding scenarios depicted on the website were partly created with professional athletes under controlled conditions and do not serve as instructions.

7. Rights to Content

All content on the website, particularly texts, photographs, videos, graphics, layout, source code as well as the BIXS brand, BIXS logo, and other trademarks, are protected by copyright and trademark law and belong to intercycle ag or its licensors.

You may access and display the content for private, non-commercial use. Any further use, in particular reproduction, editing, distribution, public performance, or commercial exploitation, requires our prior written consent.

Automated reading of content, such as by scraping or data mining, is not permitted without our consent.

The place of jurisdiction is Sursee, Canton of Lucerne, Switzerland. Mandatory jurisdiction provisions, particularly the consumer jurisdiction according to Art. 32 of the Swiss Civil Procedure Code as well as mandatory jurisdictions for consumers residing in the EU, remain reserved.
